Welcome to Flowctory. These Terms of Service ("Terms") govern your access to and use of the Flowctory website, applications, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

1. Service Description

Flowctory is a web-based application that enables users to create, manage, schedule, and publish content to social media platforms including TikTok and YouTube. The Service provides AI-powered content creation tools, a media library, cloud storage integrations, and multi-platform publishing capabilities.

The Service includes features such as:

  • Video and image uploading and processing
  • Post scheduling and queue management
  • Caption, privacy, and interaction settings configuration
  • Post history and status tracking
  • Multi-channel support (connect and manage multiple social media channels)
  • Subscription tiers with varying feature limits
  • AI-powered content creation studio (Canvas) for generating images and videos
  • Media library for organizing and reusing assets
  • Cloud storage integrations (Google Drive, Dropbox) for importing and exporting media

Flowctory does not guarantee any specific outcomes from using the Service, including but not limited to video views, engagement, follower growth, or the quality of AI-generated content.

2. Eligibility

To use the Service, you must:

  • Be at least 16 years of age if you reside in the European Union, or 13 years of age if you reside elsewhere (or the minimum age required in your jurisdiction)
  • Have a valid channel on at least one supported platform (TikTok, YouTube) in good standing to use the posting features
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Accounts and Registration

3.1 Account Registration

To use the Service, you must create a Flowctory account. You can register using:

  • Email address and password
  • Google OAuth (Sign in with Google)

By registering, you agree to provide accurate and complete information and to keep your account information updated.

3.2 Connecting TikTok Channels

To use the TikTok posting features, you must connect at least one TikTok channel. This is done separately from account registration using TikTok's OAuth system. By connecting a TikTok channel, you authorize Flowctory to:

  • Access your basic TikTok profile information (display name, avatar, unique identifier)
  • Upload video content to your TikTok channel on your behalf
  • Store OAuth tokens necessary for API communication

You may connect multiple TikTok channels to your Flowctory account, subject to your subscription plan limits.

3.3 Connecting YouTube Channels

To use the YouTube posting features, you may connect one or more YouTube channels via Google OAuth. By connecting a YouTube channel, you authorize Flowctory to:

  • Access your basic YouTube channel information (channel name, avatar)
  • Upload video content to your YouTube channel on your behalf
  • Store OAuth tokens necessary for API communication

You may connect multiple YouTube channels to your Flowctory account, subject to your subscription plan limits.

3.4 Connecting Cloud Storage

You may optionally connect cloud storage services (Google Drive, Dropbox) to import and export media files. By connecting a cloud storage account, you authorize Flowctory to:

  • Read and list files in designated folders within your cloud storage
  • Upload processed media files to your cloud storage
  • Store OAuth tokens necessary for API communication

You may disconnect cloud storage accounts at any time from your Flowctory settings. Disconnecting revokes Flowctory's access to your cloud storage.

3.5 Account Security

You are responsible for maintaining the security of your account and any activities that occur under your account. You agree to:

  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized access to your account
  • Not share your Flowctory session with others

3.6 Revoking Access and Account Deletion

You may disconnect platform channels, cloud storage, or delete your Flowctory account at any time:

  • Disconnect individual social media channels or cloud storage from your Flowctory settings
  • Revoke access in each platform's app permissions settings
  • Revoke YouTube API access via Google's security settings at security.google.com/settings/security/permissions
  • Delete your Flowctory account entirely from account settings

Upon account deletion, we will delete your stored data in accordance with our Privacy Policy. Active subscriptions will be cancelled at the end of the current billing period.

4. Payment Terms

Flowctory offers both free and paid subscription plans. The free plan provides basic access to the Service with limited features. Paid plans (Creator, Studio and Pro) offer increased limits, additional features, and AI generation credits.

4.1 Subscription Plans

Current subscription options include:

  • Free: Basic access with limited uploads per month and limited connected channels
  • Creator: Unlimited posts and direct posting from canvas for growing creators, available monthly or yearly
  • Studio: 3,000 AI credits/mo with canvas tools and scheduling for AI artists and video creators, available monthly or yearly
  • Pro: 4,000 credits and full platform access for professional content creators, available monthly or yearly

Current pricing, features, and limits for each plan are displayed on our pricing page. We reserve the right to modify pricing and features with reasonable notice.

4.2 Billing and Payment

All payments are processed securely through Stripe. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis (monthly or yearly)
  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You can manage your subscription and payment methods through the billing portal
  • Price changes will be communicated in advance and take effect at your next billing cycle

4.3 Free Trials

New subscribers to paid plans may be eligible for a free trial period. During the trial:

  • You will have full access to the selected plan's features
  • Your payment method will be charged at the end of the trial unless you cancel
  • You may cancel at any time during the trial without charge

4.4 Cancellation

You may cancel your subscription at any time from your account settings or billing portal:

  • Cancellation takes effect at the end of your current billing period
  • You retain access to paid features until the end of the billing period
  • After cancellation, your account reverts to the free plan

4.5 Refunds

Refund requests are handled on a case-by-case basis. We comply with applicable consumer protection laws, including the European Union's 14-day withdrawal right for digital services where applicable. To request a refund, contact us at contact@flowctory.com.

4.6 AI Generation Credits

AI content generation features (Canvas) consume credits included with your subscription plan:

  • Each subscription tier includes a monthly allocation of AI generation credits
  • Credit consumption varies by generation type (image generation, video generation) and model used
  • Credits reset at the start of each billing period and do not roll over
  • When credits are exhausted, AI generation features are unavailable until credits reset or your plan is upgraded

5. License to Flowctory Services

5.1 License Grant

Subject to your compliance with these Terms, Flowctory grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

5.2 Restrictions

You may not:

  • Copy, modify, or distribute the Service or any part thereof
  • Reverse engineer, decompile, or disassemble the Service
  • Rent, lease, or lend the Service to third parties
  • Use the Service to develop a competing product or service
  • Remove or alter any proprietary notices or labels
  • Use automated systems (bots, scrapers) to access the Service without permission

5.3 Ownership

Flowctory retains all right, title, and interest in and to the Service, including all intellectual property rights. These Terms do not grant you any ownership rights in the Service.

6. User Content

6.1 Your Content

You retain ownership of any content you upload through the Service ("User Content"). By uploading User Content, you grant Flowctory a limited, non-exclusive license to:

  • Process and temporarily store the content for the purpose of publishing to connected platforms
  • Display content status and metadata within the Service

This license terminates when your content is deleted from our systems (typically within 24 hours of upload or upon successful posting to the target platform).

6.2 AI-Generated Content

The Service provides AI-powered tools (Canvas) for generating images and videos using third-party AI models. Regarding AI-generated content:

  • AI-generated content created through the Service is provided for your use, subject to the terms of the underlying AI model providers
  • Flowctory does not guarantee the quality, accuracy, appropriateness, or legal compliance of AI-generated content
  • You are solely responsible for reviewing AI-generated content before publishing and ensuring it complies with applicable laws and platform guidelines
  • You should not assume exclusive intellectual property rights over AI-generated content, as the legal framework around AI-generated works is evolving
  • Some platforms may require disclosure that content was AI-generated. You are responsible for making appropriate disclosures

6.3 Content Responsibility

You are solely responsible for your User Content and represent that:

  • You own or have the necessary rights to the content
  • Your content does not infringe any third-party intellectual property rights
  • Your content complies with the community guidelines and terms of service of the platforms to which it is published
  • Your content does not violate any applicable laws

6.4 Content Moderation

While Flowctory does not actively monitor User Content, we reserve the right to remove or refuse to process any content that violates these Terms or applicable law. Each connected platform ultimately controls the publication and moderation of all content posted through their platform.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that is defamatory, obscene, harmful, or violates others' rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to send spam, unsolicited messages, or engage in abusive behavior
  • Upload malware, viruses, or any malicious code
  • Circumvent any rate limits, access controls, or security measures
  • Use the Service in any manner that could damage, disable, or impair any connected platform's services
  • Violate the terms of service or community guidelines of any connected platform

8. Third-Party Terms

8.1 TikTok Platform

The Service relies on TikTok's Content Posting API. Your use of the Service is also subject to TikTok's Terms of Service and Community Guidelines. You acknowledge that:

  • TikTok may modify, suspend, or discontinue their API at any time
  • TikTok may reject, remove, or restrict content posted through the Service
  • TikTok's rate limits and policies may affect the Service's functionality
  • Videos posted through unaudited applications may be subject to additional restrictions by TikTok (such as being set to private by default)

8.2 YouTube Platform

The Service integrates with the YouTube API Services for content publishing. By using YouTube features, you agree to be bound by the YouTube API Services Terms of Service and Google's Privacy Policy. You acknowledge that:

  • Google may modify, suspend, or discontinue the YouTube API at any time
  • YouTube may reject, remove, or restrict content posted through the Service
  • YouTube's API quotas and policies may affect the Service's functionality
  • You must comply with YouTube's Community Guidelines when publishing content

By using the YouTube features, you also agree to be bound by Google's Privacy Policy at policies.google.com/privacy.

You can also revoke Flowctory's access to your YouTube data at any time through Google's security settings at security.google.com/settings/security/permissions.

8.3 Payment Processing

Payment processing is provided by Stripe. Your use of Stripe's services is subject to Stripe's Terms of Service.

8.4 AI Generation Services

The Canvas feature uses third-party AI model providers for image and video generation. You acknowledge that:

  • AI-generated content is produced by third-party services, not by Flowctory directly
  • AI model providers may modify, update, or discontinue their models at any time, which may affect generation quality or availability
  • Your use of AI-generated content may be subject to the terms and acceptable use policies of the underlying AI model providers
  • AI models may occasionally produce unexpected, inaccurate, or inappropriate outputs. You are responsible for reviewing all generated content before use

8.5 Cloud Storage Services

The Service integrates with third-party cloud storage providers (Google Drive, Dropbox) for media import and export. You acknowledge that:

  • Your use of cloud storage integrations is subject to the respective provider's terms of service
  • Flowctory accesses only the files and folders you explicitly authorize
  • Cloud storage providers may modify or discontinue their APIs, which may affect integration functionality
  • You are responsible for managing your cloud storage content and ensuring you have rights to any files imported into the Service

8.6 Other Third-Party Services

The Service may contain links to or integrations with other third-party services. Flowctory is not responsible for the content, policies, or practices of any third-party services.

8.7 TikTok Content Sharing Compliance

Flowctory operates in accordance with TikTok's Content Sharing Guidelines and Direct Post API Developer Guidelines. By using the Service, you acknowledge and agree to the following:

  • Content Integrity: Flowctory does not add any watermarks, logos, branding, promotional text, or make any modifications to your video content. Videos are transmitted directly to TikTok exactly as you upload them.
  • Authentic Content: Flowctory is designed for creators to post their own original content to TikTok. The Service is not intended for automated cross-platform posting or republishing content from other sources without proper rights. You are responsible for ensuring you have the rights to all content you upload.
  • Commercial Content Disclosure: When posting commercial or branded content, you must use the Service's disclosure tools to properly indicate whether you are promoting your own brand or a third party's brand, in compliance with TikTok's advertising policies.
  • Music Usage: Before posting content, you must confirm that you have the necessary rights to any music or audio in your videos, in accordance with TikTok's Music Usage Confirmation requirements. The Service requires your explicit consent before uploading.
  • Privacy and Interaction Settings: You are responsible for selecting appropriate privacy levels and interaction settings (duet, stitch, comments) for each post. The Service does not set default values for privacy—you must make an active selection.
  • Channel Verification: The Service retrieves your TikTok channel information before each posting session to ensure content is posted to the correct channel and to display available options based on your channel settings. If TikTok indicates that your channel cannot post at that moment, the Service will halt the publishing attempt and prompt you to try again later.
  • Post Status Notifications: After submitting content, the Service monitors your post's processing status and notifies you when your video is published or if an error occurs. Content processing may take a few minutes before appearing on your TikTok profile.
  • API Audit Status: Until the Service passes TikTok's API audit, certain restrictions apply as required by TikTok's policies. These may include limitations on the number of users who can post within a 24-hour period and restrictions on privacy settings for published content. Once the audit is complete, these restrictions are lifted.
  • Community Guidelines: You must comply with TikTok's Community Guidelines and Terms of Service. Content that violates these guidelines may be rejected by TikTok or result in action against your TikTok channel.
  • AI-Generated Content Labeling: Content created using Flowctory's Canvas AI features and posted to TikTok is automatically labeled as AI-generated in accordance with TikTok's content policies. This label ("Creator labeled as AI-generated") is applied by TikTok when the content is published.

9. Intellectual Property

9.1 Copyright Infringement

Flowctory respects intellectual property rights and expects users to do the same. If you believe that content uploaded through our Service infringes your copyright, please contact us with the following information:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

9.2 Repeat Infringers

We may terminate the accounts of users who are determined to be repeat infringers of intellectual property rights.

10. Term and Termination

10.1 Term

These Terms remain in effect while you use the Service.

10.2 Termination by You

You may stop using the Service at any time by deleting your Flowctory account from your account settings. Upon deletion, any active subscriptions will be cancelled at the end of the current billing period, and we will delete your stored data in accordance with our Privacy Policy.

10.3 Termination by Flowctory

We may suspend or terminate your access to the Service at any time, with or without cause, including if we reasonably believe:

  • You have violated these Terms
  • Your use of the Service poses a security risk
  • Continued provision of the Service is no longer commercially viable

10.4 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.

11. Disclaimers and Limitation of Liability

11.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Flowctory does not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Any defects will be corrected
  • The Service will meet your specific requirements
  • Content will be successfully published to connected platforms

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLOWCTORY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any connected platform's rejection, removal, or restriction of your content
  • API rate limits, downtime, or changes to connected platforms
  • The quality, accuracy, or appropriateness of AI-generated content

11.3 Consumer Rights

If you are a consumer in the European Union, you may have statutory rights that cannot be waived. Nothing in these Terms affects those rights. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in France. If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence.

12.3 EU Online Dispute Resolution

If you are a consumer in the European Union, you may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Updating the "Last updated" date at the top of these Terms
  • Providing notice through the Service or via email (for significant changes)

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should stop using the Service.
